Megan's Law
In 1994, the rape and murder of
seven-year-old Megan Kanka prompted
the public to demand broad-based community notification when dangerous
sex offenders are released into a community. As a result, on
May
17, 1996
, President
Clinton signed a law, dubbed Megan's Law, requiring states to inform
a community when a convicted offender moves in. The states are allowed
the discretion to establish criteria for disclosure, but the law
compels them to make private and personal information on registered
sex offenders available to the public.
Nevada legislation (NRS 179D.730)
establishes three levels of notification, depending upon the risk
of recidivism of the sex offender:
(a) Tier 1 level of notification is assigned if the risk of recidivism
is low. Notification must be made by the law enforcement agency
in whose jurisdiction the sex offender resides or is a student
or worker to law enforcement agencies that are likely to encounter
the sex offender.
(b) Tier 2 level of notification is assigned if the risk of recidivism
is moderate. Notification must be made by the law enforcement
agency in whose jurisdiction the sex offender resides or is a
student or worker to law enforcement agencies, schools, and religious
and youth organizations that are likely to encounter the sex offender.
(c) Tier 3 level of
notification is assigned if the risk of recidivism is high. Notification
must be made by the law enforcement agency in whose jurisdiction
the sex offender resides or is a student or worker to law enforcement
agencies, schools, and religious and youth organizations that
are likely to encounter the sex offender. Notification is also
to be given to the public through means designed to reach members
of the public who are likely to encounter the sex offender.
Sex offenders who have been declared
to be a sexually violent predator must be assigned a Tier 3 level
of notification.
NRS 179D requires all offenders
convicted of certain sex offenses and crimes against children after
July
1, 1956
to register
with the local law enforcement agency within 48 hours of residency.
They are also required to notify appropriate agencies of any change
of address and provide updated information within a 48-hour time
frame. Updates to this site's information are made regularly. However,
information may not be current based on the sex offenders' compliance
or noncompliance with the registration requirements. Law enforcement
agencies will arrest sex offenders who are not in compliance with
Nevada
registration laws. If you believe that any of the information found
