The Civil Section is responsible, as mandated by state statute, to provide the civil service process in both civil and criminal cases throughout the County. Staff members process and serve thousands of court documents each year. A wide variety of papers are handled by the Civil Section, including temporary protection orders, subpoenas, summons, writs of execution, and court hearing orders.

The Civil Section is staffed by one sergeant, two deputies, six full-time investigative assistants, and nine office personnel. The Civil Section is expected to grow as demands for services increase and the population of Washoe County expands.

In order to provide convenient service to the public, the Civil Section currently maintains three separate offices:

All three offices are open Monday through Friday, 8:00 a.m. to 5:00 p.m., except holidays.

COST/FEE SCHEDULE

All documents for service must include payment at time of request.  If the request for service is mailed, payment must be in the form of a money order or cashier’s check.  Changes to the fee schedule reflected in NRS 248.275, EFFECTIVE JUNE 30, 2002, are as follows:

If the original paper and affidavit of service are to be returned to you, please include a self-addressed, stamped envelope. If the envelope is NOT provided, the paperwork will be sent directly to the court.

If we are unable to serve the papers, we will retain a fee for the attempts made.

EVICTION PROCEDURE

The Sheriff's Office will endeavor to complete an eviction as soon as possible. In order to perform this service in a timely manner as required by the court, the Sheriff's Office and the landlord must work closely together. The landlord or their representative must be available to speak with the deputy who is scheduling the eviction and must provide a telephone number where they can be reached between 8:00 a.m. and 5:00 p.m. - no voice mail or answering machine. The landlord or their representative must be able to perform the eviction within 30 minutes of being contacted by the deputy.

At the time set for the eviction, two deputies will meet the landlord or a designated representative at the address of the eviction. The deputies drive unmarked cars but are in uniform.

It is important that the landlord, or the designated representative of the landlord, and the locksmith (if needed) be on time. If for some reason one or all of the above are not at the address on time, the eviction will be cancelled. The entire procedure will have to be repeated, and another service fee will be charged.

Be prepared to wait up to 30 minutes. The deputies are sometimes delayed by additional law enforcement duties. The deputies will remove each and every person on the premises. Any personal property in the dwelling will have to be removed by the tenant at a time that has been arranged with the landlord. If there are any animals left on the property, it is the landlord's responsibility to care for the animals.

If the evicted tenant breaks into the dwelling after the eviction, the landlord is to call the law enforcement agency that has jurisdiction for the area.

If the landlord wants to cancel the eviction, the Reno office (328-3544) or Sparks office (353-7605) must be called. If there are any questions, call either of the two offices.

There is no refund of service fees for a cancelled eviction.
